Welcome to Cadura, an AI-powered longevity and discipline coach that helps you build better habits for a longer, healthier life. By using the Cadura app, website, or voice-call features, you agree to these Terms of Service. Please read them carefully before using the product.

1. Purpose of the Service

Cadura provides automated coaching, reminders, and motivational check-ins through AI voice interactions. The Service encourages consistent daily actions related to wellbeing—such as movement, rest, nutrition awareness, and recovery—and helps you stay accountable to your personal goals.

1.1 Wellness Coaching — Not Medical Advice

Cadura is a wellness-coaching tool, not a medical application. It does not provide medical advice, diagnosis, or treatment and must never replace professional healthcare. Always consult a qualified medical professional about any health condition or before making significant lifestyle changes.

The AI voice assistant is intentionally programmed not to offer medical guidance or make clinical claims.

If you connect Apple Health or similar integrations, Cadura may access limited data (steps, activity, or sleep) solely to personalize your coaching experience. Such data is stored securely, used only to provide coaching insights, and never sold or used for advertising.

2. Eligibility

You must be at least 18 years old to use Cadura. By using the Service, you confirm that

  • you have read and understood these Terms, and
  • you have the legal capacity to enter into a binding agreement.

3. Use of the Service

You agree to use Cadura only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account and all activity under it.

We may suspend or terminate access if you misuse the Service, attempt to reverse-engineer it, or generate or distribute harmful content.

4. Data and Privacy

We collect and process limited data to deliver and improve Cadura, including

  • your stated goals and preferences,
  • voice recordings or transcripts from AI sessions, and
  • activity data (steps, movement, sleep) if you connect Apple Health or similar services.

By using the Service, you consent to this processing. We never sell personal data and share it only with trusted infrastructure or analytics partners essential for operation. See our Privacy Policy for full details on GDPR and HealthKit handling.

5. Subscriptions, Payments, and Refunds

If you purchase a paid plan (Base, Pro, or Ultra):

  • Billing occurs through the App Store, Play Store, or our website's payment provider (e.g., Stripe).
  • Fees are charged in advance and are non-refundable except where required by law.
  • Pricing or features may change with notice provided in-app or by email.
  • Any applicable taxes or platform fees are displayed before purchase.

Refunds and Credit Usage

All Cadura subscriptions include a defined number of AI-coaching credits that represent access to voice or text coaching sessions which incur real-time AI processing costs.

Once credits are consumed—partially or fully—the corresponding portion of the Service is considered delivered and non-refundable. We do not offer refunds for early credit usage, overconsumption, or perceived lack of results.

If you cancel your subscription before renewal and have unused credits, those credits remain valid until the end of your billing cycle and will not be refunded.

In certain cases (for example, technical failures), we may offer discretionary refunds at our sole judgment, but we are not obligated to do so.

By purchasing and using Cadura, you acknowledge that:

  • You consent to immediate access to digital content.
  • You understand that performance begins upon purchase.
  • You lose your legal right of withdrawal once credit usage begins.

Stripe Billing and Taxes

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the billing period. Prices include applicable taxes unless otherwise specified. Billing is processed securely through Stripe, and your payment information is not stored on our servers.

6. Intellectual Property

All content, designs, and software associated with Cadura are owned by SUMOSMASH UG (or its licensors) and protected by copyright and trademark laws. You may not copy, modify, or redistribute any part of the Service without written permission.

7. Disclaimer of Warranties

Cadura is provided “as is” and “as available.” We make no warranties regarding accuracy, reliability, or suitability for a particular purpose. Use is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, SUMOSMASH UG, its founders, and affiliates are not liable for indirect, incidental, or consequential damages—including loss of data, profits, or health outcomes—arising from use of the Service.

9. Indemnification

You agree to indemnify and hold harmless SUMOSMASH UG, its officers, employees, and affiliates from claims or damages resulting from your misuse of Cadura or violation of these Terms.

10. Changes to These Terms

We may update these Terms periodically. The latest version is always available in-app and on our website. Continued use after updates means you accept the revised Terms.

11. Governing Law

These Terms are governed by German law. Any disputes will be handled by the competent courts of Berlin, unless mandatory consumer protection laws provide otherwise.
